Separated owners

Where an owner is separated (i.e., married or in a civil partnership but no longer cohabiting and not yet divorced prior to completion), one or more of the following requirements must be met in order for us to proceed:

  • The application is for a new purchase with no monies being put toward the purchase from the separated partner unless it is a settlement from the divorce/separation
  • The application is a remortgage with a Transfer of Equity (ToE), subject to evidence or confirmation of a financial 'pay-out' (benefit) for the separated partner
  • The application is a remortgage where the separated partner has been previously removed from the title
  • The owner will have received at least a Conditional Order (formerly Decree Nisi) prior to completion

Where an owner intends to continue maintaining strong financial links with the separated partner (e.g., ongoing joint loans or mortgages), we will be unable to proceed.
