In Scotland, non-borrowing occupiers—such as adult children aged 17 and over—are not required to sign an occupancy waiver. This differs from our requirements for properties in England and Wales.
However, due to the Matrimonial Homes (Family Protection) (Scotland) Act 1981 or Civil Partnership Act 2004, any spouse or civil partner not named on sole-application mortgage must sign the Standard Security as a 'consenter' to postpone their statutory occupancy rights and recieved Independent Legal Advice (ILA).
