Occupier's consent and postponement deed - no independent legal advice (ILA) required
Any occupiers – defined as individuals residing or due to reside in the property, such as adult children (17+), must be disclosed and must complete an occupancy waiver form.
This document must be signed by every person aged 17 or over who will occupy the property after the mortgage is completed and who is not a party to the mortgage.
This form is available to the conveyanver through the LMS portal.
Please note: we will not be able to approve the COT until this document is signed and returned to us.
Occupier's consent and postponement deed - independent legal advice (ILA) required
At the time of application, we will confirm any third-party occupiers who require ILA before signing the occupier's waiver form. We will require the consent of the legal owner(s) and the contact details of the third party to facilitate communication and share relevant mortgage details.
Situations where ILA is typically required:
- When a third-party occupier is gifting part or all of the deposit
- When a third-party occupier is the spouse or civil partner of the legal owner
- Where occupier is also the income booster
- When there are significant financial ties between the third-party occupier and the legal owner

- The above list is not exhaustive and the requirement for third party occupier ILA is subject to underwriter discrection
- Where third party occupier ILA is required, we will reach out to the occupier and their chosen solicitor with the relevant forms
- It is required that the ILA meeting is carried out face-to-face
